1. Objective and Scope of Policy

AppHero, Inc. (“AppHero”/“we”/”us”) is committed to protecting your privacy. We make the AppHero application which provides customized app recommendations based on your Facebook profile and the apps you already own (the “App”) available for download to supported devices through Apple Inc’s App Store. We also make the website, http://www.apphero.com (the “Website”) available to you as your source for information on our company, the App and any other products or services we offer or are planning to offer in future. This Privacy Policy describes how we collect, store, use and distribute information about our users through the App, the Website and any related services (collectively the “Services”). Your use of the Services are also governed by our Terms of Use which can be read at any time by clicking here http://www.apphero.com/terms.

Our goal is to collect, use and disclose only that information reasonably required to enable us to provide the particular product or service that you have requested, to maintain our customer/visitor lists and/or to respond to your inquiries or feedback and for other purposes further described in this Policy. If you have provided us with contact information, we will maintain the confidentiality of your contact information and use it only for the purposes for which we have collected it, unless you agree that we may disclose it to other third parties (subject to the exclusions we have listed below).

The App and certain of our services are dependent on access to information from third party sites such as Facebook and Apple. Your use of any third party sites in conjunction with the Website, Services or App is subject to the applicable Terms of Service and Privacy Policy of those particular sites.

2. Acceptance of Terms

By using the AppHero Website and/or the Services, you consent to the collection and use by AppHero of Personal Information as described in this Privacy Policy. If you do not agree to any terms in this Policy, you should not download the App or use the Services.

3. Collection of Information

AppHero may collect two types of information: Personal Information and Non-Personal Information.

"Personal Information" means information which identifies and relates to you as an individual such as your name, address, e-mail address, birth date and gender. If you wish to use the App, you will need to provide us with access to your Facebook account where we may be able to see the following information, if available: your name, Facebook id, gender, location and hometown, languages, time zone, email address, interests, education, other biographical features if you have filled them out and other optional information you make available on Facebook such as political and religious views and affiliations, favourite quotes, relationship status, “Likes” and “Preferences”. We will not have access to any of your private messages and we will use the information we do have access to, solely to provide the Services to you. It is always your choice whether or not to provide Personal Information including access to your Facebook account and the information contained therein. However, if you choose not to provide requested Personal Information or access you will not be able to use the App.

The following is a non-exhaustive list of the main means by which AppHero may collect Personal Information on this Website or through the Apps:

We also may receive Personal Information from our business partners and other third parties, provided that such third parties confirm to us that their use of the Personal Information conforms to applicable privacy laws.

Information from other sources/social networking sites. In order to use the App fully, you will be required to link your Facebook account with us so that we can recommend apps to you. You can also engage with our content, such as applications and other offerings, on or through (1) third-party social networking sites, such as Facebook, (2) third-party social media plug-ins and applications, and (3) our social media plug-ins and applications that may be available through third-party sites or services. When you link your account or engage with our content on or through third party social networking sites, social media plug-ins or applications, you may allow us to have ongoing access to certain information from your social media profile (e.g., name, e-mail address, your profile picture or its URL, gender, birthday, your physical location and that of your access devices, your list of friends, the posts or the 'likes' you make and other data on an opt-in basis from your Facebook profile).

When you provide information from your social media profile, it can help enable us to do things like (1) give you exclusive content, (2) personalize your online experience with us within and outside our applications or websites, and (3) contact you through the social networking sites or directly with the latest news, special offerings, and rewards. By linking your social media profile to your AppHero account, you are authorizing AppHero to collect, store, and use in accordance with this Privacy Policy any and all information that you agreed the social networking site could provide to AppHero through the social networking site Application Programming Interface.

Information collected from mobile devices. If you access our Services on your mobile telephone or other mobile device, we also collect your unique device identifier and may collect location information. We may also collect information about other applications you already have downloaded on your mobile telephone or mobile device if you opt-in to that service. We use this information to avoid recommending apps which you already have and to recommend apps of a similar type that you appear to prefer.

"Non-Personal Information" is information of an anonymous nature, such as an Internet Protocol Address (IP Address), the domain used to access the Website, and the type and version of browser or operating system being used. Aggregate information, such as demographic statistics of our users (e.g. average age or geographical allocation of our users), number of visitors, what pages users access or visit, average time spent on this Website, and information volunteered by the user, such as survey information, is also considered Non-Personal Information. Business contact information such as the name, title, business address or telephone number of a business or professional person or an employee of an organization is not considered Personal Information.

Non-Personal Information is collected or derived by us in the course of operating the Website, the App, and the Services. For example, our web servers may automatically collect Non-Personal Information which is provided through your browser or stored on a cookie when you choose to visit the Website. We need this information in order to operate the Services, but we do not share it with any third parties. This policy does not restrict our use of Non-Personal Information.

Certain reputable third parties may provide us with data collection, reporting, ad response measurement, site analytics, as well as assist with delivery of relevant marketing messages. These third parties may view, edit, or set their own cookies. The use of these technologies by these third parties is subject to their own privacy policies and is not covered by this privacy statement.

“Cookies” are used by AppHero, our third party service providers, and our partners to track content usage and traffic on this Website. A cookie is a feature of your web browser that consists of a text file that is placed on your hard disk by a webpage server. AppHero uses cookies to help it compile aggregate statistics about usage of this Website, such as how many users visit the Website, how long users spend viewing the Website, and what pages are viewed most often. This information is used to improve the content of the Website. You can set your browser to notify you when you are sent a cookie. This gives you the chance to decide whether or not to accept it. If you disable cookies however, you may not be able to take advantage of all the features of this Website or our Services.

4. Use of Personal Information

AppHero collects Personal Information mainly for the following purposes:

Your Personal Information will not be used for any purpose other than those abovementioned without your consent. AppHero does not actively collect personally identifiable user information for the purpose of sale or marketing in a way that specifically identifies the individual. In other words: we don’t sell customer lists.

5. Disclosure of Information

AppHero feels very strongly about keeping the Personal Information you give us confidential. AppHero will not share the Personal Information we collect from you with any third party, except as indicated below.

Important Exceptions

We may disclose your Personal Information to a third party without your consent if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other Website users or anyone else that could be harmed by such activities. We may disclose Personal Information when we believe in good faith that such disclosure is required by and in accordance with the law.

We may also disclose your Personal Information in connection with a corporate re-organization, a merger or amalgamation with another entity, or a sale of all or a substantial portion of our assets provided that the information disclosed continues to be used for the purposes permitted by this Privacy Policy by the entity acquiring the information.

6. Outside Parties and Sites

When you post information on social networking sites with our Services, or when you interact with our Services through social networking sites (depending on your privacy settings), social media plug-ins or similar applications, this information could be seen by anyone on the Internet. Therefore, we cannot prevent further use of this information. You can control what data you share through privacy settings available on some social networking sites. Through AppHero, you may be introduced to a variety of third party vendors and websites. The privacy policies of these third parties are not under our control and may differ from ours. The use of any information that you may provide to any third party, or the use of “cookie” technology by any third party, will be governed by the privacy policy of the operator of the website that you are visiting. If you have any doubts about the privacy of the information you are providing on another website, we recommend that you contact that website directly for more information and review its privacy policy.

7. Security

The security of your Personal Information is important to us. We use commercially reasonable efforts to ensure that your Personal Information is stored and maintained in a secure environment. We protect the Personal Information you give us by putting it behind multiple levels of firewalls, with active intrusion detection systems.

You can help protect the security of your Personal Information. For instance, never give out your password to another person, and remember to log out of your account and close your browser window when you finish using the Website, so that other people using the same computer won't have access to your Personal Information. We will never ask you for your password in an unsolicited phone call or in an unsolicited e-mail.

8. Retention

AppHero will keep your Personal Information for as long as it remains necessary for the identified purposes in Section 4 or as required by law, which may extend beyond the termination of our relationship with you.

Upon your written request to support@apphero.com, AppHero will endeavor to delete any Personal Information stored in our databases within ten business days of receipt of such request. You acknowledge and agree that if you request that your Personal Information be removed from our databases, it may not be possible to completely delete all your Personal Information due to technological and legal constraints.

9. Law & Compliance

Certain of our servers are located in Texas, accordingly your Personal Information may be available to the government or government agencies in the USA and your information may be accessed by the US government or agencies under a lawful order, irrespective of the safeguards we have put in place for the protection of your Personal Information.

10. Amendment of this Policy

If we find it necessary or desirable to change our Privacy Policy in the future, we will post an appropriate notice on the AppHero Website. Any change to this Privacy Policy will become effective 30 days following the date the change is posted and will apply to information collected from the date of the posting of the revised Privacy Policy and to existing information held by AppHero. The date on which the latest update was made is indicated at the top of this document. We recommend that you print a copy of this Privacy Policy for your reference and revisit this policy from time to time to ensure you are aware of any changes. Your continued use of the AppHero Website, Apps and/or Services signifies your acceptance of any changes to this policy.

11. Access and Accuracy

You have the right to access your Personal Information to verify the Personal Information that we have collected in respect of you. Upon receipt of your written request, we will provide you with a copy of your information. We will make every reasonable effort to keep your Personal Information accurate and up-to-date, and we will enable you to revise the Personal Information as appropriate. Having accurate Personal Information about you enables us to give you the best possible service.

You can help us ensure the accuracy of the data we hold about you by keeping us informed of any changes such as a change of email address. 12. Additional Privacy Protections for Children

AppHero joins the industry in recognizing that children, including young teens, may not be able to make informed choices about Personal Information requested online. Accordingly, AppHero does not target children or teenagers (younger than thirteen years of age) for collection of information online. AppHero does not solicit or collect Personal Information targeted at children and teenagers under thirteen. In addition, AppHero will encourage children to seek the consent of their parents before providing any information about themselves or their households to anyone on the Internet.
